{"id":711,"date":"2014-06-13T21:18:27","date_gmt":"2014-06-14T02:18:27","guid":{"rendered":"http:\/\/cherrylandarc.com\/?page_id=711"},"modified":"2014-06-13T21:23:21","modified_gmt":"2014-06-14T02:23:21","slug":"ham-news-articles","status":"publish","type":"page","link":"https:\/\/cherrylandarc.com\/?page_id=711","title":{"rendered":"Ham News Articles"},"content":{"rendered":"<p>FCC Okays Changes to Amateur Radio Exam Credit, Test<br \/>\nAdministration, Emission Type Rules<\/p>\n<p>In a wide-ranging Report and Order (R&amp;O) released June 9 that takes<br \/>\nvarious proceedings into consideration, the FCC has revised the<br \/>\nAmateur Service Part 97 rules to grant credit for written<br \/>\nexamination elements 3 (General) and 4 (Amateur Extra) to holders of<br \/>\n&#8220;expired licenses that required passage of those elements.&#8221; The FCC<br \/>\nwill require former licensees &#8211; those falling outside the 2-year<br \/>\ngrace period &#8211; to pass Element 2 (Technician) in order to be<br \/>\nrelicensed, however. The Commission declined to give examination<br \/>\ncredit to the holder of an expired Certificate of Successful<br \/>\nCompletion of Examination (CSCE) or to extend its validity to the<br \/>\nholder&#8217;s lifetime.<\/p>\n<p>The Report and Order may be found on the web in PDF format at,<br \/>\n<a id=\"yui_3_16_0_1_1402712192461_2096\" href=\"http:\/\/transition.fcc.gov\/Daily_Releases\/Daily_Business\/2014\/db0609\/FCC-14-74A1.pdf\" target=\"_blank\" rel=\"nofollow\"><span style=\"text-decoration: underline;\"><span style=\"color: #0066cc;\">http:\/\/transition.fcc.gov\/Daily_Releases\/Daily_Business\/2014\/db0609\/FCC-14-74A1.pdf<\/span><\/span><\/a><br \/>\n.<\/p>\n<p>&#8220;Our decision to grant credit for written examination Elements 3 and<br \/>\n4 for expired licenses that required passage [of those elements]<br \/>\nwill provide some relief for former General, Advanced, and Amateur<br \/>\nExtra class licensees,&#8221; the FCC said, &#8220;and is consistent with how we<br \/>\ntreat expired pre-1987 Technician class licensees who want to<br \/>\nreenter the Amateur Service.&#8221; Pre-1987 Techs can get Element 3<br \/>\ncredit, since the Technician and General class written examinations<br \/>\nin that era were identical. The Commission said current rules and<br \/>\nprocedures that apply to expired pre-1987 Technician licenses &#8220;are<br \/>\nsufficient to verify that an individual is a former licensee under<br \/>\nour new rules.&#8221;<\/p>\n<p>The Commission said that requiring applicants holding expired<br \/>\nlicenses to pass Element 2 in order to relicense &#8220;will address<br \/>\ncommenters&#8217; concerns about lost proficiency and knowledge, because a<br \/>\nformer licensee will have to demonstrate that he or she has retained<br \/>\nknowledge of technical and regulatory matters.&#8221; The FCC said the<br \/>\nElement 2 requirement also would deter any attempts by someone with<br \/>\nthe same name as a former licensee to obtain a ham ticket without<br \/>\nexamination.<\/p>\n<p>In 1997 the FCC, in the face of opposition, dropped a proposal that<br \/>\nwould have generally allowed examination element credit for expired<br \/>\namateur operator licenses. In the past, the FCC has maintained that<br \/>\nits procedures &#8220;provide ample notification and opportunity for<br \/>\nlicense renewal&#8221; and that retesting did not impose an unreasonable<br \/>\nburden. The issue arose again in 2011, with a request from the<br \/>\nAnchorage Volunteer Examiner Coordinator.<\/p>\n<p>The FCC pulled back from its own proposal to reduce from three to<br \/>\ntwo the minimum number of volunteer examiners required to proctor an<br \/>\nAmateur Radio examination session. The ARRL, the W5YI-VEC and &#8220;a<br \/>\nclear majority of commenters&#8221; opposed the change, the FCC said. The<br \/>\nFCC said it found commenters&#8217; arguments persuasive that that the use<br \/>\nof three VEs &#8220;results in higher accuracy and lower fraud that would<br \/>\nbe the case with two VEs.&#8221; In a related matter, though, the<br \/>\nCommission embraced the use of remote testing methods.<\/p>\n<p>&#8220;Allowing VEs and VECs the option of administering examinations at<br \/>\nlocations remote from the VEs is warranted,&#8221; the FCC said. The<br \/>\nNational Conference of Volunteer Examiner Coordinators (NCVEC) in<br \/>\n2002 endorsed experimental use of videoconferencing technology to<br \/>\nconduct Amateur Radio testing in remote areas of Alaska. The<br \/>\nAnchorage VEC has long pushed for the change, citing the expense to<br \/>\nprovide Amateur Radio test sessions to Alaska residents living in<br \/>\nremote areas.<\/p>\n<p>The FCC declined to address &#8220;the mechanics&#8221; of remote testing,<br \/>\nwhich, it said, &#8220;will vary from location to location and session to<br \/>\nsession.&#8221; The Commission said specific rules spelling out how to<br \/>\nadminister exam sessions remotely &#8220;could limit the flexibility of<br \/>\nVEs and VECs.&#8221; The FCC stressed the obligation on the part of VECs<br \/>\nand VEs &#8220;to administer examinations responsibly&#8221; applies &#8220;in full&#8221;<br \/>\nto remote testing.<\/p>\n<p>The FCC amended the rules to provide that VEs administering<br \/>\nexaminations remotely be required to grade such examinations &#8220;at the<br \/>\nearliest practical opportunity,&#8221; rather than &#8220;immediately,&#8221; as the<br \/>\nrule for conventional exam sessions requires.<\/p>\n<p>Finally, the FCC has adopted an ARRL proposal to authorize certain<br \/>\nTime Division Multiple Access (TDMA) emissions in the Amateur<br \/>\nService. The Wireless Telecommunications Bureau in 2013 granted an<br \/>\nARRL request for a temporary blanket waiver to permit radio amateurs<br \/>\nto transmit emissions with designators FXD, FXE, and F7E, pending<br \/>\nresolution of the rulemaking petition.<\/p>\n<p>&#8220;Commenters strongly support amendment of the rules to permit these<br \/>\nadditional emission types,&#8221; the FCC noted. &#8220;The commenters assert<br \/>\nthat the proposed rule change &#8216;is consistent with the basis and<br \/>\npurpose of the Amateur Service,'&#8221; and will allow repurposing surplus<br \/>\nmobile relay equipment from other radio services in the Amateur<br \/>\nService, the Commission added.<\/p>\n<p>The FCC said it also will make &#8220;certain minor, non-substantive<br \/>\namendments to the Amateur Service rules.&#8221; It is amending Part 97 &#8220;to<br \/>\nreflect that the Commission amended its rules to eliminate the<br \/>\nrequirement that certain Amateur Radio Service licensees pass a<br \/>\nMorse code examination,&#8221; the FCC said in the R&amp;O.
